The Constitutional Court Reviewed the Case of a Judge-Military: Will Payments Be Maintained

On November 5, 2025, the Second Senate examined the case regarding the constitutional complaint of Syvukhina Hryhoriy Serhiyovych regarding labor guarantees for employees who go to military service. According to the complaint, the judge noted that the judicial remuneration to Hryhoriy Syvukhyn was not paid during his service in the Armed Forces of Ukraine.

During the examination of the case, it was established that the changes to the Labor Code that led to the non-payment of judicial remuneration violated the judges' rights to receive the corresponding guarantees. Therefore, Hryhoriy Syvukhyn turned to the administrative court with a lawsuit to recover the unpaid amount for October 2023.

The Cherkasy District Administrative Court satisfied his claim, but the decision was annulled by the Sixth Appeals Administrative Court. The Supreme Court refused to initiate cassation proceedings but sent the case to the Grand Chamber of the Court.

From the conclusions of the constitutional complaint and the attached materials, the following is evident.
The court reviewed the materials of this case and moved to the closed part of the plenary session.

As a result of the court hearing, the decision on the non-payment of judicial remuneration to Hryhoriy Syvukhyn remained unchanged, but the case was referred to the Grand Chamber of the Court for further consideration.
