According to ХВИЛЯ: Ukraine's Territorial Recruitment Centers (TRCs) operate under strict time constraints when imposing penalties. An administrative fine for violating military registration rules can be issued within three months of the violation being discovered, but no later than one year from the date the offense was committed. Once this one-year period expires, the TRC loses its legal authority to fine the individual.

In Ukraine, breaching military registration rules is classified as an administrative offense. It's important to clarify that Ukrainian law does not recognize a formal status of 'administrative search.' Genuine search procedures are governed solely by the Criminal Procedure Code. The actions of TRCs regarding individuals evading registration are regulated by the Code of Ukraine on Administrative Offenses, specifically Article 38, which defines the deadlines for imposing penalties.

Deadlines for Penalty Enforcement

According to the law, for offenses outlined in Articles 210 and 210-1 of the Code, a penalty must be applied within three months of its discovery. Crucially, enforcement is only possible if initiated within one year of the violation's date. If more than a year has passed since the offense, the TRC forfeits the right to issue a fine. Consequently, a person cannot remain in a state of potential penalty indefinitely, and the 'Reserve+' application often automatically removes the relevant marker after the annual deadline lapses.

Furthermore, a military enlistment office cannot fine someone twice for the same specific incident. However, a new violation-such as ignoring another summons-constitutes grounds for a separate fine. This system underscores the need for citizens to be aware of both the deadlines and the potential consequences tied to military registration rules.
