According to ХВИЛЯ: Receiving a military service deferral to care for a close relative does not automatically grant permission to leave Ukraine. An additional document is required, as the criteria for the Territorial Recruitment Center (TRC) and the State Border Guard Service are governed by separate regulations. The right to a deferral and the right to cross the border are established by different acts of the Cabinet of Ministers.

Required Documentation

To obtain the deferral itself, a citizen must acquire a formally certified 'Act on Establishing the Fact of Care Provision,' known as Appendix 8. This document has a strict, government-approved format. However, for crossing the border, a different regulation-Cabinet Resolution No. 57-applies. Under this rule, border guards require a separate 'Act' specifically intended for border crossing. This border-crossing act is issued by local self-government bodies, such as the executive committees of village, settlement, or city councils, and can be composed in a free-form style.

Possessing only Appendix 8 could lead to a denial of exit at the border.

Lawyer Yuriy Ayvazyan clarifies: 'Appendix 8 is specifically for obtaining the deferral. At the same time, Resolution No. 57 provides for a different act specifically for crossing the state border.'
