Will they deport from Poland if they lose temporary protection in 2026

The loss or expiration of temporary protection status does not mean that Ukrainian citizens are automatically subject to deportation from Poland or other EU countries. After this status expires, Ukrainians can utilize other legal grounds for continued residence. This was stated by lawyer Serhiy Starenky in the broadcast of «Morning.LIVE», reports In Poland.

Temporary protection in Poland: what will happen after its expiration

According to the lawyer, information about the possible termination of the temporary protection mechanism should not be perceived as an automatic loss of the right to reside for all Ukrainians.

He noted that the current statements regarding the future of this mechanism are mainly political in nature and do not, in themselves, change the rules for Ukrainian citizens already residing in EU countries.

Serhiy Starenky emphasized that the expiration of temporary protection does not mean immediate forced return to Ukraine.

Can Ukrainians be deported from Poland after losing protection

After the expiration of temporary protection, Ukrainians can apply other legal ways to stay in Poland or another EU country.

Among the possible options are:

  • staying within the visa-free regime for up to 90 days;
  • applying for a residence permit through employment;
  • obtaining grounds for residence through education;
  • relocating to another EU country, if this complies with local legislation.

The lawyer emphasized that the issue of deportation can only be considered when a person has exhausted all legal means for continued residence in the country and has no legal grounds to remain on its territory.

Thus, the loss of temporary protection by itself does not mean automatic deportation. The future status of each individual will be determined based on their specific situation and the possibility of obtaining another form of legal residence.

For reference, it is proposed in Poland to impose 30 years imprisonment for violations in the army.
