Verdict for Former Kyiv Council Deputy
The Kyiv City Prosecutor's Office is appealing the verdict for a former Kyiv City Council deputy who was convicted for a traffic accident that left a female pedestrian with serious injuries. While the Obolon District Court of Kyiv found the woman guilty of violating traffic rules, the prosecution disagrees with the court's decision, arguing the driver caused the accident while under the influence of drugs.
The prosecution's case relies on the conclusion of a narcologist and the results of a toxicological examination, which confirm the presence of cannabis metabolites in the defendant's system. The prosecutor had asked the court to find the driver guilty under Part 2 of Article 286-1 of the Criminal Code of Ukraine and to impose a sentence of 6 years and 6 months of imprisonment. Additionally, the prosecutor sought to revoke her driver's license for 8 years.
Case Reclassification
However, the court reclassified the charges from Part 2 of Article 286-1 to Part 2 of Article 286 of the Criminal Code of Ukraine. Consequently, the court imposed a sentence of 5 years of imprisonment with a 3-year driving ban. Under Article 75 of the Criminal Code of Ukraine, the woman was released from serving the sentence and placed on a 3-year probationary period. The prosecutor's office plans to appeal this court decision. This information was provided by the press service of the Kyiv City Prosecutor's Office.
This case highlights ongoing legal debates in Ukraine regarding accountability for impaired driving. The prosecution's planned appeal could lead to a higher court review, potentially setting a precedent for how similar cases involving drugs are adjudicated in the future. The outcome may influence public discourse on the adequacy of penalties for driving under the influence and their role in preventing road accidents.
This case resonates with another recent incident where a driver received a lengthy sentence for a fatal crash involving drug impairment at a crosswalk. Such comparisons highlight the ongoing discussions about the legal consequences of impaired driving in Ukraine and may influence future rulings in similar cases.
