In Ukraine, the rules for receiving compensation for damaged housing that is jointly owned have been updated. The changes came into effect on January 5 and are intended to lift the suspension of payments and simplify the process for co-owners, where the most disputes previously arose. This is reported by the Legal Advisor for Internally Displaced Persons.
The new norms are enshrined in Cabinet Resolution No. 1525 and relate to the compensation provision procedure within the eRecovery program. From now on, the mechanism for submitting an application and interaction between co-owners has become more detailed and flexible.
Compensation for damaged housing: what has changed for co-owners
Previously, submitting an application by one co-owner required the mandatory consent of others, which often made it impossible to receive compensation. The approach has now changed.
Key innovations:
- an application can be submitted by one co-owner
- if other co-owners do not submit objections, the application is considered submitted by all
- the recipient of compensation assumes the obligation to restore the damaged housing.
eRecovery for co-owners: objections and informing
For the first time, the procedure for objections has been regulated. Co-owners have 15 days from the date of application submission to submit a written objection in any form. If an objection is received from at least one person, the commission refuses payment, and the dispute is resolved through agreements or through the court.
The fixation of informing co-owners has also become mandatory. The application must include:
- confirmation of delivery of a registered letter
- a document rejecting receipt of the letter
- or other evidence of notification.
The wording regarding the consent of co-owners has also been changed. Now, consent can be provided if possible, rather than being mandatory. If a co-owner does not submit either consent or objection, the commission may decide to grant compensation.
Separately, the obligation of the recipient of compensation to ensure the restoration works are carried out according to the checklist and the amount of payments has been established.
Recall that under the eRecovery program, in 2025 the payment of compensations for 180 thousand families amounted to almost 60 billion UAH.
