Night Shift: The State Labor Service Explained How Long It Lasts and When It Is Shortened

In Ukraine, work performed from 10 PM to 6 AM is considered night work, and its duration has its peculiarities under ordinary conditions. The State Labor Service of Ukraine explained how night shifts are regulated according to labor legislation. This is reported by Sud.ua.

According to Article 54 of the Labor Code of Ukraine, the duration of the shift is usually shortened by one hour when working at night. At the same time, this rule does not always apply and has defined exceptions.

Night Shift According to the Labor Code: Basic Rules

The State Labor Service notes that the shortening of the night shift does not apply to employees who already have a shortened working time. This specifically refers to persons engaged in work under harmful working conditions or in other cases provided by law.

Labor legislation also allows for not shortening the night shift if it is due to the specifics of production or labor organization.

Night Work During Martial Law: What Changes

The State Labor Service emphasizes that separate rules apply under martial law. According to Article 8 of the Law of Ukraine 'On the Organization of Labor Relations in Conditions of Martial Law', the norms regarding the shortening of the duration of night work are temporarily not applied.

Thus, during martial law, employers can set night shifts of the same duration as daytime ones, regardless of the general provisions of the Labor Code of Ukraine.

It is reminded that the State Labor Service also reported that annual leave in Ukraine can start even on a Saturday, Sunday, or public holiday.
