Employees of the Territorial Centers for Staffing and Social Support (TCC and SS) cannot detain and hold citizens, as this violates the Constitution of Ukraine. Lawyer Oleksandr Protas stated this on the air of the channel 'Pershyi'.
Absence of the right to detain and hold individuals
During the broadcast, the host asked the lawyer: 'Do TCCs and SS have the right to detain people?'. The expert unequivocally answered: 'They have no rights to do so'.
'They have no rights to do so', – said Protas.
The lawyer explained that the Constitution clearly prohibits the use of troops to limit the rights of citizens, which means that TCCs and SS also cannot do this.
New rules for deferral from mobilization
Protas emphasized that TCCs and SS are part of the Armed Forces and are subordinate to them, therefore the prohibition on limiting the rights of citizens also applies to their employees.
The Ukrainian lawyer stressed that representatives of TCCs and SS do not have legal powers to detain or hold citizens, as this directly contradicts Article 17 of the Constitution of Ukraine. He also emphasized that this prohibition extends to employees of such institutions.
