Supreme Court Upholds Confiscation of Unjustified Asset
The Supreme Court of Ukraine has upheld the seizure of an unjustified asset used by V. Kiriyenko, head of the Southeastern Interregional Department for Criminal Punishment Execution under the Ministry of Justice. The Civil Cassation Court within the Supreme Court affirmed earlier rulings by both the first-instance and appellate courts of the High Anti-Corruption Court, which had granted a lawsuit filed by a prosecutor from the Specialized Anti-Corruption Prosecutor’s Office (SAPO). The case sought to declare the asset unjustified and confiscate it for the state through civil forfeiture.
Case Details
At the center of the case is a 2021 LAND ROVER RANGE ROVER VOGUE, valued at 3,290,400 Ukrainian hryvnias (approximately $90,000) at the time of acquisition. The vehicle was purchased in 2023 by the official’s daughter, acting in his interests. The court agreed with the prosecutor’s arguments, which demonstrated that the official could indirectly exercise powers equivalent to the right to dispose of the asset.
The court rejected the appeal, and the Supreme Court’s decision is final and not subject to further appeal. The lawsuit was based on materials from the National Agency for Prevention of Corruption (NAPC) and the State Bureau of Investigation (SBI), as well as evidence independently gathered by the prosecutor.
