Parenting children under 8 years old allows parents to work remotely in Poland: what are the conditions

In Poland, parents with children under 8 years old can officially apply for remote or flexible forms of employment. Such opportunities are provided by the updated provisions of the Labor Code and apply to both mothers and fathers. InPoland.net.pl writes about this.

According to the current regulations, parents of children up to 4 years old have the right to apply for remote work, and the employer is obliged to fulfill this request in most cases. Refusal is only possible when the nature of the work or the organization of labor in the company makes remote work impossible. This right is enshrined in Article 67¹⁹ § 6 of the Labor Code of Poland.

Remote work for parents in Poland: key conditions

An employee must submit a request at least 21 days before the planned start of remote work. In the case of office positions, employers generally agree to such a format, as there are no objective obstacles to fulfilling responsibilities outside the office.

The only grounds for refusal can be:

  • the specifics of the work that do not allow for remote duties;
  • the internal organization of labor in the company, incompatible with remote work.

Flexible schedule for parents of children under 8 years old

For employees raising children under 8 years old, broader opportunities are provided. According to Article 188 of the Labor Code, they can submit a request for a flexible work schedule.

These forms include:

  • remote work;
  • reduced working hours or weeks;
  • interrupted working day;
  • individual or variable start working hours;
  • extended daily working hours.

To implement this right, the employee must submit a written request with the chosen form of work organization.
