Contradictory Expert Reports Lead to Acquittal in High-Profile Ukrainian Corruption Case

High Anti-Corruption Court Issues Acquittal

On July 14, 2026, the High Anti-Corruption Court of Ukraine acquitted a former deputy head of a regional branch of the state railway company Ukrzaliznytsia (the South-Western Railway division). The decision stemmed from conflicting assessments provided by state forensic institutions, which made it impossible to prove guilt beyond a reasonable doubt. This case highlights ongoing challenges in Ukraine’s anti-corruption efforts, where reliance on state experts can complicate prosecutions.

In 2017, the accused, who was then serving as acting head of the tender committee, ensured that two companies won a procurement contract for power supply units for passenger railcars. During the investigation, the National Anti-Corruption Bureau (NABU) and the Specialized Anti-Corruption Prosecutor's Office (SAPO) obtained a state expert report indicating losses of 9.6 million hryvnias. However, the defense submitted a separate report from the same institution that contradicted these findings, denying any losses.

Forensic Examination and Aftermath

Given the conflicting expert opinions, the court ordered a new comprehensive forensic examination at a different state institution. Although the study took over a year, the experts were unable to confirm or refute the existence of losses. During the hearings, the prosecutor dropped the charges, while the victim, Ukrzaliznytsia, continued to press them independently. Ultimately, the court delivered an acquittal.

This case underscores the critical need for objective and independent expert evaluations in corruption-related proceedings.

Given that NABU and SAPO have been advocating for the creation of an independent forensic body, this situation raises concerns about the ability to effectively punish corruption offenses. Without such mechanisms, public trust in the justice system and law enforcement agencies may erode—a vital factor in the country's fight against corruption.

The recent acquittal in the high-profile corruption case highlights the ongoing struggles within Ukraine's anti-corruption framework. In light of these challenges, it's crucial to examine the broader implications of corruption in the country. For instance, over 366 million UAH in irregularities have been identified by Ukraine's Anti-Corruption Agency, indicating a pressing need for reforms and independent oversight to combat corruption effectively.
