Legal Reforms for Foreign Personnel in the Ukrainian Military
Ukrainian President Volodymyr Zelenskyy has signed Law No. 4730-IX, establishing the legal status and healthcare provisions for foreign nationals and stateless persons serving in the Armed Forces of Ukraine. The law will take effect three months after its publication and introduces new rules for foreigners seeking to sign military service contracts. This move formalizes the status of the International Legion and other foreign volunteers who have been fighting for Ukraine since the full-scale invasion began.
New Residency Requirements and Healthcare Guarantees
Under the new legislation, foreign nationals or stateless persons must submit the following documents to obtain a temporary residence permit:
- An application;
- A military registration document (service ID);
- A contract for military service.
These provisions also apply to individuals serving in the State Special Transport Service and the National Guard of Ukraine. Crucially, the military unit is obligated to inform migration authorities if a service contract is terminated or dissolved.
Furthermore, the law stipulates that the Cabinet of Ministers of Ukraine must define the specifics of providing medical assistance to foreigners serving in military formations. It is noted that citizens of the Russian Federation are excluded from the amendments to the Cabinet resolution adopted on February 5th, which concerns the implementation of migration legislation under martial law.
The application period for exchanging a temporary residence permit for other eligible foreigners is 90 days from the date the resolution comes into force. This law represents a significant step in securing the legal status of foreigners wishing to participate in Ukraine's defense and in guaranteeing them necessary medical care while on duty.
The adoption of this law reflects the growing need to attract foreign citizens to serve in the Ukrainian armed forces, particularly in the context of the ongoing conflict.
