Alimony debtors may lose their driver's licenses through the enforcement system. In Ukraine, according to Article 71 of the Law 'On Enforcement Proceedings', there is a possibility of restricting the right to drive for alimony non-payers. This applies to individuals who have debts exceeding six months and who are entered into the debtor registry.
A state or private executor has the right to file a motion to restrict the right to drive. Drivers who fall under this category only learn about the problem during a patrol stop. According to data, thousands of Ukrainians were restricted from driving last year, indicating the seriousness of the situation.
Procedure for returning the driver's license
To return the driver's license, one must contact the executor with confirmation of debt repayment. However, if an individual continues to drive a vehicle after the documents have been seized, this can be regarded as malicious evasion. In such cases, additional punishment may be imposed — a fine or even a temporary driving ban for up to six months, as stated by lawyer Marina Kovalenko.
Thus, the enforcement system in Ukraine aims to compel alimony debtors to fulfill their financial obligations, which can lead to serious consequences for those who ignore their duties.
This initiative is part of a broader state strategy to ensure the enforcement of court decisions and support children who are beneficiaries of alimony. In times of economic crisis, it is important to provide financial support to families in need, and limiting the rights of debtors may become an effective tool for achieving this goal. At the same time, social aspects must also be considered, as imposing restrictions can lead to additional difficulties for those who are already in a difficult financial situation.
