According to the ruling of the Shevchenkivskyi District Court, a resident of Zaporizhzhia underwent a medical commission, which recognized him as fit for mobilization. In March 2024, they attempted to hand him a summons, but the defendant categorically refused to accept it and evaded mobilization.
In court, the man did not admit guilt and stated that he 'did not evade mobilization'. The resident of Zaporizhzhia added that he refused the summons because 'the TCK violated his rights regarding the accounting and issuance of his military document.'
Punishment for evading mobilization
The court analyzed the materials of the case and explained that the defendant, for more than a year and a half after refusing to accept the summons, intentionally evaded appearing at the TCK and SP and during the review of the criminal proceedings did not make any attempts to rectify the situation and join the ranks of the Armed Forces, which indicates his conscious and deliberate actions aimed at avoiding conscription for mobilization.
The resident of Zaporizhzhia was found guilty under Article 336 of the Criminal Code of Ukraine. He was sentenced to three years of imprisonment.
This sentence can still be appealed in the appellate court.
