According to ХВИЛЯ: According to lawyer Vladyslav Derii, mobilized service members are not required to independently seek a new military medical commission (VLC) assessment once their previous one expires, provided their health status remains stable. The responsibility for initiating this mandatory medical review lies with their military command and relevant medical institutions, who must act on proper medical grounds. This clarification addresses a common point of confusion for those serving under mobilization orders in Ukraine.

The lawyer explained that personnel face no disciplinary, administrative, or criminal sanctions for failing to proactively initiate the VLC process themselves. While undergoing the commission is a compulsory part of military service, the legal onus to start the procedure rests squarely with the command structure, not the individual soldier.

Command Authority to Order Medical Examinations

Direct superiors, starting from the commander of a separate unit and above, hold the authority to refer subordinates for a VLC examination. However, this can only be done based on a recommendation from a healthcare facility's doctor. Such a recommendation is typically made if an illness or injury is discovered during a routine medical check or treatment that could affect the service member's fitness for duty.

Consequently, mobilized personnel can be assured that their health will be evaluated according to established standards without needing to personally instigate the process, as long as their condition is unchanged. This policy is designed to ensure that health monitoring is systematic and managed by the chain of command.

This guidance is crucial for service members, as it relieves them of an additional bureaucratic burden regarding their medical status.
