Military Enlistment Office Employee Fined for Assaulting a Civilian in Khmelnytskyi Region
Fine for Abuse of Official Authority
According to Главком: A court in the Khmelnytskyi region has imposed a 17,000 hryvnia fine on a senior soldier from a notification team for exceeding his official authority. The incident occurred on May 9 of this year in the village of Vinkivtsi, Khmelnytskyi district, where the serviceman struck a citizen and used tear gas during a conflict that broke out on Sobornoi Ukrainy Street near the Aurora store. Such cases highlight ongoing tensions between military personnel and civilians in Ukraine amid mobilization efforts.
According to court materials, three Territorial Center for Recruitment and Social Support (TCC) employees were carrying out citizen notification measures. However, the court noted that the TCC staff did not identify themselves, failed to show their service IDs, and were wearing uniforms without rank insignia, which constitutes a violation. The defendant was in tactical clothing without chevrons, epaulets, or name tags, while the other two employees were in civilian attire. The notification team also lacked a video recorder, complicating the documentation of their actions.
Court Ruling and Its Implications
The court reviewed photographs that captured the unlawful actions of the TCC representatives. In court, the TCC employee admitted his guilt. In its conclusions, the court emphasized that the TCC serviceman violated the provisions of Articles 11 and 16 of the Internal Service Statute of the Armed Forces of Ukraine and used physical force while performing his duties.
This case underscores the importance of adhering to procedures and norms when carrying out official duties, especially in situations where military personnel interact with the civilian population.
Violations of regulations and insufficient identification can lead to conflicts and an escalation of violence, endangering both citizens and the servicemen themselves. The court's decision may serve as a signal to other TCC representatives and military personnel about the need to comply with established norms and rules in their activities.
The ongoing challenges faced by military personnel are not limited to interactions with civilians. In a separate incident, a sergeant was penalized for failing to respond during an air raid siren, highlighting the critical need for adherence to protocols during emergencies.
