Court Ruling on Unauthorized Construction in Kyiv

According to Прокуратура Київ: In a significant legal move, a Kyiv resident has been ordered by the court to tear down a house and other structures he illegally built on forest land. The case was brought by prosecutors from the Dnipro District Prosecutor's Office in Kyiv, who uncovered that the man had unlawfully occupied a 0.1740-hectare forest plot located on Kyoto Street in the Desnianskyi district of the city. This area is part of the protected forest fund, making the unauthorized construction a serious violation of environmental and land-use laws.

On the seized land, the individual constructed a residential house with a terrace, a utility block, and a gazebo-all without obtaining the necessary permits. Despite this, he managed to register ownership of these illegally built structures through a private notary. Later, he transferred the property to his son via a gift deed, further complicating the legal situation.

The Court's Decision

The Desnianskyi District Court of Kyiv ruled in favor of the prosecutor's office, terminating the current owner's rights to the illegally built structures and ordering their demolition. This verdict marks a crucial step in protecting forest fund territories from unlawful encroachment.

This case highlights the critical need to comply with land-use regulations, especially in protected zones like forest reserves, where environmental preservation is paramount.

The ruling not only safeguards ecological interests but also sets a precedent for similar cases, potentially deterring future illegal constructions in forest areas. The actions taken by the prosecutor's office and the court demonstrate the state's commitment to combating land grabs and upholding the rule of law in urban environments.
