A court has now confirmed that individuals who previously held valid protection status in an EU or EFTA country may be refused S-status in Switzerland. Crucially, the expiration of a residence permit in another country does not automatically guarantee the right to protection in Switzerland.

The court does not oblige Swiss authorities to wait for confirmation from the country of previous stay, and its ruling on this matter is final. This development follows Switzerland's earlier move to restrict the automatic granting of S-status for new applicants based on their region of origin within Ukraine. For current holders of S-status, temporary protection remains valid until March 4, 2027.
