In Poland, checks on labor contracts will be strengthened: what will change from January 1, 2027

From January 1, 2027, the National Labor Inspectorate of Poland will be able to exchange data with the tax administration KAS and the social insurance institution ZUS. This is expected to help inspectors more accurately identify cases when labor relations are disguised as civil law contracts. The first checks of contracts in Poland began in the summer of 2026.

Contract checks in Poland: new powers for PIP from January 1, 2027

The reform of the labor inspection came into force on July 8, 2026. Since then, inspectors can make decisions to requalify a civil law contract into an employment contract if the actual working conditions have features of labor relations.

According to Krason, from July 8 to September 18, 1164 complaints regarding improperly concluded contracts were submitted to 16 district inspections. Inspectors issued 355 orders to reclassify such agreements into employment contracts. At that time, 287 contracts had already been changed, and the deadlines for fulfilling the remaining directives had not yet expired.

Until the end of 2026, PIP will review applications from employees. From the new year, access to KAS and ZUS data, according to the inspector, will enable more targeted checks. Earlier, we separately discussed how the reform affects working conditions in Poland.

Employers in Poland are advised to review contracts by the end of 2026

Krason urged employers to check on their own whether the contracts they have concluded reflect the actual working conditions. If a civil law agreement actually conceals labor relations, it can be changed before the new data exchange rules come into effect.

«There will be no leniency», — emphasized the chief inspector, adding that proven violations will have serious consequences for employers. Ukrainians working in Poland under a contract of mandate should also know how to confirm their work experience through ZUS.
