In Poland, more and more workers combine their main job with side work, freelancing, or their own business. However, in some cases, the employer has the right to prohibit additional employment. This is reported by InPoland.

When in Poland Can a Second Job Be Prohibited

Polish legislation generally allows for working two jobs or engaging in entrepreneurial activity. This applies to both employment contracts and civil law agreements or freelancing.

However, there are exceptions when an employer can limit the employee's additional employment.

These include:

  1. violation of non-competition conditions;

  2. risk of disclosing commercial secrets;

  3. conflict of interest;

  4. deterioration of performance of the main job.

Most often, restrictions apply to employees who have access to important company information, work with the employer's clients, or engage in similar business activities.

What Threatens Employees for Violating the Rules

In Poland, an employer can officially impose a ban on competitive activities through a separate written agreement.

Such a document must clearly specify:

  • scope of prohibited activities;

  • duration of restrictions;

  • consequences of violating the conditions.

In addition, problems may arise if the second job affects the quality of the main work. For example, due to fatigue, regular lateness, or failure to perform duties.

In such cases, the employer has the right to impose disciplinary penalties.
