Return of the premises of Dragomanov University

According to Главком: Dragomanov University returned its premises: the court annulled the illegal lease for the restaurant. The premises of the central building of the Ukrainian State University named after Mikhail Dragomanov were returned to the educational institution after a court decision based on the prosecutor's lawsuit. The premises, covering over 152 sq. m, located on the first floor of the university on Ivan Franko Street in the Shevchenkivskyi district, were illegally used for restaurant business. The value of the property is estimated at almost 9 million UAH.

Court Decision

The Kyiv city prosecutor addressed the Economic Court of Kyiv with a demand to declare the lease agreement void. The court recognized the use of the premises for the restaurant as illegal, which led to the execution of its decision. The premises were vacated by the tenant and transferred back to the university. The Northern Appeal Economic Court upheld the decision to return the premises to the territorial community of Kyiv.

Moreover, the prosecutor demands to recognize the ownership of a spontaneously built commercial premise in the Desnyansky district for the capital community. This case highlights the importance of protecting state property and ensuring legality in the use of communal objects.

The return of the premises of Dragomanov University after the illegal lease is significant not only for the institution itself but also for ensuring compliance with legislation in the field of communal property use. This case can serve as a signal for other organizations and enterprises about the necessity to comply with lease agreement conditions and legality in their activities. It also emphasizes the prosecutor's active role in protecting the interests of the community and the state.
