Military registration of part-time workers: should the TCC be notified about the deferment

In Ukrainian companies, there is a question regarding the military registration of employees who have received deferments from mobilization at their place of work in a part-time capacity. As of December 4, 2023, a legislative norm comes into effect that allows strategically important enterprises to temporarily employ military personnel. This decision aims to ensure the stability of such enterprises' functioning during wartime.

Temporary reservation of employees can last up to 45 days within a calendar year. It is important to note that an employee who is reserved at the place of work in a part-time capacity is not counted towards the total number of military personnel when calculating the reservation limit at the main enterprise. This means that companies can effectively utilize resources, avoiding exceeding permitted quotas.

Question about notifying the TCC

The resolution of the Cabinet of Ministers of Ukraine No. 76 dated January 27, 2023, regulates the issue of reserving employees; however, the question remains whether it is necessary to notify the Territorial Recruitment Center (TCC) about the deferment in the case of part-time workers. This question requires further clarification to ensure that companies comply with all legislative requirements and avoid potential legal consequences.

Thus, the issue of military registration of part-time workers remains relevant for Ukrainian companies seeking to ensure their operations in a state of martial law while adhering to all necessary norms and rules.

The mentioned legislation reflects the state's efforts to support strategically important enterprises amidst military challenges.

Clarification regarding the notification of the TCC about deferments for part-time employees will be an important step in ensuring legal certainty for both companies and employees who may be at risk of mobilization. Addressing these issues will contribute to stability in the labor market and enable effective functioning of enterprises under challenging conditions of martial law.
