Revised Employment Rules for People with Disabilities
Updated regulations governing the employment of people with disabilities took effect in Ukraine on January 1, 2026. A key change is the introduction of quarterly monitoring to ensure employers meet established hiring quotas for this segment of the population. Companies that fail to comply with these requirements will be obligated to pay a targeted financial contribution.
Revised Formula for Calculating the Average Monthly Wage
The Cabinet of Ministers of Ukraine, through its Resolution No. 268, has approved a new methodology for calculating the average monthly wage, which is used to determine the amount of this contribution. The formula divides the total quarterly payroll by the average number of employees and then by three, representing the number of months in a quarter.
It is important to note that the following payments are excluded from this calculation:
- Payments made under civil law contracts,
- Sick leave payments,
- Maternity and childbirth benefits.
Furthermore, when calculating the average headcount for the contribution, several employee categories are excluded. These include individuals on maternity leave, those on childcare leave for children under three, employees on extended unpaid leave, workers with suspended employment contracts, and mobilized personnel. This reform is part of broader efforts to improve employment conditions for people with disabilities in Ukraine. These changes align with ongoing initiatives to enhance workplace inclusion and accessibility across the country.
The updated disability employment rules represent a significant step toward ensuring equal opportunities for this population group. The implementation of quarterly compliance monitoring is designed to incentivize employers to hire more people with disabilities actively. This policy shift has the potential to substantially improve their social standing and foster greater integration within society.
