The Case Against Yulia Tymoshenko

Yulia Tymoshenko, leader of the Batkivshchyna party, has filed a motion to recuse Judge Dubas of the High Anti-Corruption Court (VAKS), with a new hearing now set for this Friday. Judge Dubas himself presided over the motion's submission. During that session, a live broadcast was prohibited, and neither Tymoshenko nor her lawyer was permitted to speak. The next hearing is scheduled for 14:30 in VAKS courtroom number five, located at 42a Khreshchatyk Street, Kyiv.

This case stems from a raid on the Batkivshchyna office on January 13, 2026, where anti-corruption agents seized $40,000 from Tymoshenko. The following day, January 14, the National Anti-Corruption Bureau (NABU) and the Specialized Anti-Corruption Prosecutor's Office (SAPO) formally notified her of suspicion for allegedly offering an unlawful benefit to members of parliament. The agencies released an audio recording of a conversation between Tymoshenko and Servant of the People MP Ihor Kopytin, who is himself the subject of a separate NABU investigation.

  • On January 16, 2026, the High Anti-Corruption Court imposed a bail measure of 33.3 million hryvnias on Tymoshenko.
  • She was ordered to surrender her foreign passport, not to leave the Kyiv region without permission, and to refrain from communicating with certain named MPs.
  • The full bail amount was posted on her behalf on January 23, 2026.
  • On January 26, the court rejected an appeal to cancel the bail but modified the terms, allowing her to contact MPs and travel freely within Ukraine.

Subsequent rulings have seen some relief for Tymoshenko. On February 16, 2026, the VAKS Appeals Chamber overturned a seizure order for part of the Tymoshenko family's property, and on February 26, NABU returned the $40,000 seized during the January 13 raid. Regarding the recusal motion, Yulia Tymoshenko stated:

“Today we filed a motion to recuse Judge Dubas, whose bias and ignorance have been witnessed by the entire country.”
She expressed her intent to continue the legal fight:
“Tomorrow we will make another attempt, publicly and with a live broadcast, to restore justice and remove Judge Dubas from our court proceedings.”
Tymoshenko also issued a direct invitation to journalists, remarking:
“A special invitation for journalists. It will be heated.”

Political Tensions

The situation surrounding Yulia Tymoshenko's case highlights the ongoing tensions between political and judicial institutions in Ukraine. The motion to recuse the judge signals growing dissatisfaction from Tymoshenko and her team with the court's procedural decisions. Her emphasis on public transparency and media coverage underscores the high-stakes, politically charged nature of this proceeding. The outcome of this case could significantly influence Ukraine's political landscape, particularly with future elections on the horizon. This is a prominent example of Ukraine's continued struggle to balance anti-corruption efforts with due process in high-profile cases.
