Determining the Need for Permanent External Care

According to ХВИЛЯ: Attorney Oleksiy Mendrukh has detailed the criteria and procedure for establishing a need for permanent external care, based on clarifications issued by Ukraine's Ministry of Health (MOH) on March 12. This guidance is crucial for individuals with significant limitations in their ability to perform daily life activities. The system is designed to provide support to those who cannot manage essential tasks independently and safely.

According to the MOH, eligibility for permanent care can be established under two main conditions. The first is a significant (third-degree) limitation in one or more life activity criteria. The second is a pronounced (second-degree) limitation in two or more criteria. However, a pronounced limitation in just a single criterion is typically not sufficient grounds to establish a need for care.

Criteria for Life Activity Limitations

Permanent external care can be provided to individuals with a first A or first B category disability. People with a second-category disability may also qualify, provided they meet the required degrees of limitation in the specified life activity criteria.

Attorney Mendrukh noted: 'The assessment team considers not just whether a person can perform an action in principle, but whether they can do so consistently and safely, without threat to life or health and without significant pain.'

The criteria for life activity limitations encompass five key areas:

  • Self-care (hygiene, dressing, eating, taking medication)
  • Mobility (pace, distance, ability to leave home safely)
  • Orientation (ability to orient oneself in time and space, recognize people and situations)
  • Communication (ability to clearly express needs and obtain help)
  • Behavioral control (adherence to safety rules and social norms)
Mendrukh also emphasized: 'If performing an action is accompanied by significant pain or a risk to life and health, it is considered that such an action cannot be performed independently.'

These new clarifications in defining the need for permanent external care could significantly impact people with disabilities and their families. Clearer criteria are expected to streamline the process of obtaining necessary assistance.
