According to Главком: Ukraine's state-owned energy company, Naftogaz, has won a significant legal battle against Russia's Gazprom. The Swiss Federal Supreme Court has dismissed Gazprom's appeal, thereby upholding an international arbitration award from June 2025 that orders the Russian gas giant to pay Naftogaz over $1.4 billion. This final ruling compels Gazprom to settle the debt for gas transit services, along with accrued interest and legal costs.

Case Background and Details

The dispute originated when Gazprom breached its contractual 'take or pay' obligations, ceasing payments in May 2022. In response, Naftogaz initiated arbitration proceedings in September 2022 to enforce its rights. The international tribunal, composed of arbitrators from Sweden, Switzerland, and Israel, subsequently ruled that Gazprom must pay $1.37 billion to Naftogaz. This legal victory is part of a broader effort by Ukrainian entities to seek financial redress from Russian state-owned corporations following the 2022 invasion. Gazprom's attempts to obstruct the process through Russian courts were unsuccessful.

Serhiy Koretskyi, a representative for Naftogaz, stated:

“Naftogaz is working to enforce the debt collection from the Russians. A number of other legal proceedings against the aggressor state are also ongoing to seek compensation for damages.”

In a move signaling continued corporate governance, the Ukrainian government appointed a renewed supervisory board for NAK Naftogaz of Ukraine in March of this year. This court decision marks a crucial step in Ukraine's legal challenges against Russian energy interests, reinforcing the legitimacy of Naftogaz's claims and confirming Gazprom's financial obligations.
