According to ХВИЛЯ: Ukraine operates a legal framework for personal bankruptcy, providing a formal process for individuals to settle debts and resolve disputes with creditors. According to the Ministry of Justice, this mechanism allows citizens to legally reduce their debt burden and settle conflicts within the legal system. In 2025, a total of 1,371 people utilized this procedure. As the Ministry of Justice states:

'Ukrainians are using the opportunity to legally reduce their debt burden and settle disputes with creditors within the legal framework.'

Procedure Requirements and Consequences

In 2024, commercial courts initiated 962 personal bankruptcy cases. The court reviews the documentation to open proceedings within five days. Initiating the procedure requires meeting specific conditions, including:

  • loan payments must have been in default for more than 50% of the monthly amount for at least two months;
  • the debtor must possess no assets that could be seized by enforcement services;
  • clear signs of a threat of insolvency must have been present.

For those who complete the process, the status of a bankrupt individual imposes restrictions for up to five years. During this period, there is an obligation to disclose the bankruptcy status when entering into loan, guarantee, or collateral agreements. Furthermore, a citizen's business reputation will not be considered impeccable for three years following the procedure.

Submitting a bankruptcy petition to the court requires specific documentation, such as:

  • a property declaration;
  • a list of creditors;
  • information on bank accounts and income;
  • copies of transactions involving valuable property from the past year;
  • a draft debt restructuring plan.

This legal avenue offers debtors a chance for a financial fresh start. The personal bankruptcy procedure in Ukraine has become a vital tool for people facing severe financial hardship, allowing them not only to reduce their debt load but also to reintegrate into economic life. Similar debt relief mechanisms exist in many Western countries, though the specific rules vary.
