According to ХВИЛЯ: An elderly pensioner is at risk of losing his only home due to accumulated debts for utility bills and building repairs. His one-room apartment, which he has owned since 1997, has been listed for auction through the System of Electronic Trading of Seized Property (SETAM). The total amount of his debts has exceeded the legal threshold for the seizure of a person's sole residence, which is currently set at 172.9 thousand hryvnias (equivalent to 20 minimum wages). This case highlights the precarious financial situation many pensioners face on fixed incomes.

Mounting Debts and Potential Homelessness

The man's outstanding debts include:

  • 22.1 thousand hryvnias for building and grounds maintenance,
  • 17 thousand hryvnias for water supply and sewerage,
  • 7.4 thousand hryvnias for other communal payments.

Repair work carried out by the 'Kharchovyk-4' housing cooperative amounted to 201,161.06 hryvnias. Fourteen enforcement proceedings have been initiated against him, bringing his total debt to approximately 247 thousand hryvnias.

The apartment is listed for sale with a starting price of 1 million 28 thousand hryvnias. An initial auction failed due to a lack of participants. In 2024, a court ruled that he must pay the debts for services. Recently, the Verkhovna Rada passed a draft law 'On Amendments to Certain Laws of Ukraine on Simplifying Enforcement Proceedings Through Digitalization,' which raises the threshold for the confiscation of a person's only home from 20 to 50 minimum wages (to 432.3 thousand hryvnias). These changes could affect the pensioner's future and his ability to keep his apartment. The legislative shift reflects growing concerns about protecting vulnerable citizens from homelessness.

This case underscores the critical importance of legislative reforms that can significantly impact debtors' rights.

Raising the threshold for the seizure of a sole residence could offer a chance for many facing similar financial hardships to keep their homes. For this pensioner, already under the stress of potentially losing his apartment, these changes could provide a crucial lifeline amidst mounting debts.

The financial struggles of elderly citizens are not uncommon, as illustrated by a recent case where the Ukrainian Pension Fund has failed to provide full payments to retirees.
