The Constitutional Court of Ukraine is considering the case regarding judges' salaries: what will change for millions of Ukrainians

The Court considers the constitutionality of the Budget Law

On November 20, 2025, the Grand Chamber began considering the case based on the constitutional submission of the Supreme Court regarding the compliance of certain provisions of the Law of Ukraine 'On the State Budget of Ukraine for 2025' with the Constitution of Ukraine. The Court requested the Constitutional Court of Ukraine to verify this provision

The request to the Constitutional Court was related to the establishment of the subsistence minimum for working-age citizens in the budget law for 2025. This had to comply with the articles of the Constitution of Ukraine, and it concerned the independence of judges and their remuneration

'actually changes the legal regulation regarding judges' remuneration defined in a special legislative act' - the Law of Ukraine 'On the Judiciary and Status of Judges'

There are opinions that the new budget law violates the independence of judges as it establishes a lower remuneration level for them than previous laws. Therefore, the Court examines this case from the perspective of constitutionality

The Court has prepared requests to various authorities and scientific institutions to obtain additional information on this issue. After reviewing the materials, the Court moved to a closed portion of the plenary session

At the plenary session of the Grand Chamber, representatives of the entity with the right to make a constitutional submission, the Supreme Court, the Verkhovna Rada, and the President of Ukraine were present. The plenary session can be viewed on the Court's official website

The Court considers the issue of the constitutionality of the budget law for 2025, paying attention to the establishment of the subsistence minimum and remuneration for judges, which may violate their independence and compliance with the Constitution of Ukraine.
