Bill to Harmonize SME Classification Criteria

According to Мін. Економіки: The Ukrainian government has approved a draft law to bring its definitions for micro, small, and medium-sized enterprises (SMEs) in line with European Union legislation. This legislative move, titled 'On Amendments to Certain Laws of Ukraine Regarding the Definition of Business Entities,' fully aligns Ukraine's company classification criteria with EU standards, which will significantly impact the nation's small business sector. This reform is a key part of Ukraine's broader post-war economic reconstruction and integration efforts with the EU single market.

The proposed legislation modernizes the approach to defining SMEs. Previously, companies risked losing access to grants, preferential loans, and investments, and were forced to separately verify their status for European partners, creating additional hurdles for international cooperation. Furthermore, larger players artificially split their businesses to illegitimately qualify for SME benefits.

How the New Draft Law Will Affect Small Businesses

The new bill is expected to foster the growth of small businesses in Ukraine by simplifying access to financial resources and reducing administrative barriers.

The adoption of this draft law is a crucial step for integrating the Ukrainian business environment into European economic structures.

Harmonizing classification criteria could ease Ukrainian companies' access to international financial instruments and partnerships, which would positively impact the country's overall economic development. It may also reduce unfair competition from large companies that previously abused business fragmentation to obtain benefits.
