The draft law 'On Amendments to Certain Legislative Acts of Ukraine on the Protection of Land Rights of Owners of Real Estate Objects' was adopted in the second reading and as a whole, reports the press service of the Verkhovna Rada of Ukraine.

According to the press service of the Verkhovna Rada, the document is aimed at protecting the rights of citizens whose property was destroyed during the Russian aggression and provides them the opportunity to reclaim or acquire land plots that were under such properties.

According to the new norms, if property rights to real estate were terminated in the State Register of Property Rights due to destruction, former owners or their heirs may receive land plots free of charge or through transfer without conducting land auctions.

Conditions and Actions of the Law

During the martial law and for 5 years after its termination, the new conditions of the law will apply. The procedures for obtaining land plots will be simplified, and the need for developing urban planning documentation may be waived if the designation of the plot corresponds to the designation of the destroyed object.

The law also stipulates that the Ministry of Environment will obtain the right to approve the methodology for determining damage caused to land resources due to pollution or littering, and diplomatic representations may be exempted from land rent in case this is provided for by international treaties, to which the Verkhovna Rada of Ukraine has given consent.

The Verkhovna Rada adopted an important law regarding the protection of land rights aimed at restoring the rights of citizens whose property was destroyed as a result of military actions. According to the new legislation, real estate owners whose ownership was terminated due to destruction can now receive land plots free of charge or through transfer without conducting land auctions. This law also provides for simplified procedures for obtaining land plots and the exemption of diplomatic representations from paying land rent if it complies with international treaties approved by the Verkhovna Rada of Ukraine.
