Supreme Court Ruling and the Situation at Marshaliyka

According to Главком: On January 29, Ukraine's Supreme Court ruled that the transfer of a forested plot for the construction of the National Military Memorial Cemetery in Marshaliyka, Kyiv region, was unlawful. Despite this legal decision, burials at the site have not ceased; 214 service members have already been interred there. Construction is also expected to resume with warmer weather, highlighting a complex conflict between legal rulings and ongoing national needs during wartime.

Cemetery's Purpose and Future Plans

The cemetery, an idea first proposed in 2011, is intended for burials with full military honors for the fallen, including:

  • Members of the security and defense forces,
  • Police officers,
  • Heroes of Ukraine,
  • And combat veterans.

Plans are in place to complete a second construction phase by the end of 2026, which will provide space for an additional 3,000 graves.

Commenting on the Supreme Court's decision, Viktor Kobyliansky noted that

"it pertains only to the annulment of specific provisions of the Kyiv Regional State Administration's order regarding the cemetery's organization."

He further emphasized that

"changing the designated purpose of the land plots, plus any residential development, is not permitted."

The legal impact of the court's ruling is currently limited, as the original administrative order has already been executed.

Consequently, the National Military Memorial Cemetery in Marshaliyka remains operational, despite the ongoing legal dispute over the land's status. This case underscores the challenging intersection of land use law, wartime imperatives, and the nation's duty to honor its fallen defenders.
