Ukrainian courts have reversed their previous stance on pension recalculations for military retirees who were later mobilized back into service. These veterans can now have their pensions recalculated based on their increased length of service, using the rank they held at their initial retirement. This marks a significant departure from prior judicial practice, which had consistently ruled against such recalculations. This change addresses a complex issue arising from the ongoing conflict, where many retirees have been called back to active duty.
Courts Now Issuing Favorable Rulings
Legal cases concerning these pension recalculations are now beginning to receive positive outcomes. As noted by legal expert Tetiana Holytsia,
"The courts have concluded that the calculation should be based either on the new position and its corresponding service percentage, or on the old position with a percentage of the monetary allowance, also determined by the length of service at the time of the first discharge."This reasoning indicates a fundamental shift in how these claims are being adjudicated.
It is crucial to understand that the right to request a recalculation is only available after a veteran is discharged from service for a second time. Those currently serving after being mobilized cannot yet file a claim; recalculation becomes possible only after demobilization. Meanwhile, standard indexation of payments to military pensioners continues. The evolving judicial trend is clear, with
