Court-Ordered Eviction Restores Green Space in Kyiv

Authorities in Kyiv have enforced a court ruling to clear a land plot exceeding 0.5 hectares within the Partisan Glory landscape park of unauthorized constructions. An individual was found guilty of illegally occupying the land. This outcome followed a lawsuit filed by the Kyiv City Prosecutor’s Office, which sought to defend the rights of the local community.

The Darnytskyi District Court sided with the prosecution, and the verdict became legally binding in February 2026. As a result, the site was freed from a café building, wooden gazebos, and other unlawfully placed structures that had compromised the park’s integrity. In December 2024, a private entrepreneur was convicted under Article 197-1, Part 2 of the Criminal Code of Ukraine, which addresses the unauthorized seizure of particularly valuable land.

Additional Legal Actions to Reclaim Land for the Community

Beyond this case, multiple court proceedings are ongoing to return land plots to Kyiv’s territorial community. The Commercial Court of Kyiv has ordered a private company to hand back a nearly 0.7-hectare plot on Liudmyla Protsenko Street, valued at 32 million UAH. Meanwhile, the Kyiv prosecutor’s office has demanded the return of a plot on Novovokzalna Street in the Solomianskyi district to community ownership.

The Northern Commercial Court of Appeal also ruled that a private company must surrender a water fund plot on Pryrichna Street in the Obolonskyi district. This parcel spans almost 5 hectares and is worth over 632 million UAH. These decisions highlight the prosecutor’s office’s active efforts to safeguard Kyiv’s land rights.

Such judicial rulings underscore the Kyiv prosecutor’s office’s commitment to protecting community rights and restoring legality in land use. The surge in court cases aimed at reclaiming land plots reflects the authorities’ push to ensure proper management of green zones and prevent further violations in this area.

As authorities continue to address illegal land occupations, a recent ruling saw a local business lose a significant court case involving municipal land valued at over $3.3 million. This decision underscores the ongoing efforts by the Kyiv prosecutor's office to reclaim valuable land for the community, further emphasizing the importance of protecting public spaces.
