Overhaul of Mobilization Deferral Criteria

According to Главком: The Cabinet of Ministers of Ukraine has approved amendments to the rules governing mobilization deferrals for employees of strategically important enterprises. Key changes include stricter salary thresholds, revised industry-specific criteria, and the elimination of loopholes related to part-time workers’ quotas. These updates aim to streamline the exemption process and align it with current labor market conditions.

Under the new regulations, the minimum salary requirement for companies eligible for deferrals has been raised to three times the minimum wage, equivalent to 25,900 hryvnias. For businesses located in frontline areas, the threshold remains unchanged at 21,600 hryvnias. Approximately 20% of enterprises will be affected by these updated criteria, as confirmed by Oleksiy Sobolev. He noted that state bodies which previously approved the now-revised criteria must reassess their decisions regarding these firms. Those entities will be notified this week of the need to submit a new documentation package to re-establish their critical status under the updated rules.

Simplified Status Confirmation Process

Importantly, for enterprises whose criteria have not changed, a simplified procedure for confirming their status has been introduced. This requires submitting a certificate of average salary along with a tax calculation. Documents for this streamlined process must be filed by August 10. Additionally, new rules for part-time workers stipulate that they will now be counted only at their primary place of employment, defined as the job with the longest tenure.

The Cabinet's resolution was adopted in June, with previous deferral approaches having been revised in December 2024. As part of these changes, 15 ministerial orders concerning industry-specific and regional criteria have been approved, with the remaining orders expected to be published by the end of the week. The revisions to mobilization deferral rules are designed to better adapt to the country's current conditions and support the effective operation of critical enterprises.
