Changes in the procedure for processing mobilization deferments
As of November 1, the procedure for processing mobilization deferments in Ukraine has changed - now applications are accepted exclusively through the CNAP. Lawyer Roman Simutyn warned that improper adherence to the new rules may lead to the forced mobilization of citizens who have a legal right to deferment.
'If you do not arrange for a deferment, you will be taken to the TCC, and even if you have all the documents – the deferment will not be issued to you, you will simply be mobilized, and proving the illegality of the TCC's actions will be impossible,' emphasized the lawyer.
According to Simutyn, until November 1, Ukrainians could submit an application for deferment directly to the territorial recruitment centers. If the application was rejected, it was possible to challenge the TCC's actions in court and annul the decision to include them in the military unit.
The process of applying for a deferment and lawyer's advice
After the introduction of the new rules, all appeals and documents regarding deferments are accepted only in person through the Centers for Administrative Services. In case of a sudden summons, the lawyer advises immediately sending the application by mail to the CNAP with all necessary documents.
It is best to submit an application for deferment in advance, and it is also essential to keep the document that will be issued at the CNAP after submitting the application. This may serve as evidence in case of any disputes, explained the lawyer.
