Staff Booking: How Enterprises Calculate 50% of Those Subject to Military Service

According to hvylya.net: Ukrainians were explained how the number of military personnel in a private enterprise is determined and who among them can be reserved. Lawyer Andriy Topchiy stated that martial law with general mobilization is in effect in Ukraine, thus men and women on military record receive mobilization summons. There is a possibility of obtaining a deferment from conscription for certain categories of employees.

According to Ukrainian legislation on military duty, those subject to military service are citizens from the reserve who will be called up to reinforce the army and other military units during wartime, as well as to perform general defensive duties.

This category includes:
  • men aged 18 to 60 years
  • women who are on military record
Not counted are:
  • conscripts, reservists, and active servicemen
  • citizens removed from the record for medical reasons

Employees who were mobilized after May 18, 2024 are also included in the total count. To determine 50%, the enterprise must consider all those subject to military service, except for the specified categories.

Calculation Example

Lawyer Topchiy provided a practical example for an enterprise with 120 employees, where 60 men aged 18 to 60 years and women subject to military service are present. Thus, considering certain exceptions, the number of those subject to military service amounts to 48 individuals, hence 24 employees can be reserved.

'Regarding the accounting of a 24-year-old person for the purposes of reserving another military personnel: this is possible if that person at 24 is indeed subject to military service by status, not a conscript or reservist,' emphasized the lawyer.

It was previously announced that the format of printed summons for conscription will change in Ukraine.

It was explained how the number of those subject to military service in private enterprises in Ukraine is determined and who can be reserved. The regime of martial law with mobilization is taken into account along with the categories of citizens who belong to those subject to military service according to Ukrainian legislation. The lawyer provided a calculation example for the enterprise, explaining how to account for those subject to military service when reserving employees.
