Prosecutors File Suit for Demolition of Unauthorized Building

According to Главком: Kyiv's Specialized Environmental Prosecutor's Office has filed a lawsuit demanding the demolition of an illegally constructed residential building on Trukhaniv Island. The suit calls for the restoration of nearly half a hectare of water fund land, where construction was carried out without the necessary permits or approvals from the Kyiv City Council. This action highlights ongoing efforts to protect Kyiv's natural landscapes from unauthorized development.

Records show that in 2002, a foreign-registered legal entity purchased a 206-square-meter rehabilitation center building on the island. However, this center was demolished and replaced with a residential building exceeding 1,000 square meters. The owners illegally registered the property and enclosed the area with a fence. The Kyiv City Commercial Court has already opened proceedings in the case, with prosecutors demanding the land be cleared and the structure torn down.

Lawsuit Challenges Observatory Land Development

In a separate case, the Kyiv City Prosecutor's Office has petitioned the Commercial Court to invalidate a contract that would allow development on the territory of the Main Astronomical Observatory of the National Academy of Sciences of Ukraine. The case involves a 7.43-hectare plot of land, valued at over 100 million hryvnias, located on Akademika Zabolotnoho Street in the Holosiivskyi district. This area contains a locally significant natural monument known as the 'Century-Old Oaks.'

City prosecutors have also appealed a court decision that refused to seize land plots on Tsymlianskyi Lane and Kyrylivska Street, where construction is currently underway. The prosecutors have petitioned the Podilskyi District Court to impose a seizure on these plots and halt all construction work. These legal battles are part of a broader crackdown on illegal construction in Kyiv, particularly in ecologically sensitive zones.

These events underscore a heightened effort by prosecutors to protect Kyiv's environment and land resources. Unauthorized construction in areas of ecological value has raised public concern, especially regarding the preservation of natural monuments and water resources. The outcomes of these court cases could significantly influence future development in the capital and set legal precedents for protecting environmental zones across Ukraine.
