According to Главком: Mykola Yurlov, an advisor to Ukraine’s Ministry of Foreign Affairs, has stated that the Special Tribunal’s prosecutor is empowered to issue an indictment against senior Russian leadership-specifically the head of state, the prime minister, and the foreign minister. The first such indictment could be presented as early as next year. Yurlov emphasized that

“the Special Tribunal’s statute clearly stipulates that functional immunity does not apply to any individual,”

though he noted a temporary restriction on prosecuting these three particular officials while they hold office.

Establishment of the Special Tribunal

Created amid ongoing hostilities, the Special Tribunal is set to become the first international body to hold Russia’s top leadership accountable for the crime of aggression. For three years, a team of investigators and prosecutors based in the Netherlands has been gathering evidence of Russia’s aggression against Ukraine. Additionally, the International Centre for the Prosecution of the Crime of Aggression was established in 2023.

On May 15, 37 nations signed an expanded partial agreement to form the tribunal’s steering committee. Yurlov remarked that

“the Special Tribunal’s prosecutor has the authority to issue an indictment against them. This is the most significant achievement we have secured during negotiations.”

As a result, the tribunal holds considerable promise for advancing international justice and ensuring accountability for Russia’s aggressive actions.
