TCUs cannot declare individuals wanted: lawyer explained the reasons
Lawyer Alexander Protas explained that the Territorial Recruitment Centers (TCUs) do not have the right to declare individuals wanted for evasion of mobilization. He emphasized that only law enforcement agencies have the authority to conduct searches within the framework of a criminal case if there are confirmed facts of evasion from fulfilling obligations.
'A search can only arise in a criminal proceeding if a person has the status of a suspect or an accused, and the investigator cannot in any way ensure their appearance to fulfill the obligations imposed on them,' Protas explained.
According to the legislation, TCUs do not fall into the category of institutions that have the right to conduct searches. Therefore, statements about the possibility of declaring individuals wanted for evasion of mobilization are untrue and are merely a myth.
