The Constitutional Court of Ukraine may lift the ban on adoption for persons with criminal records: what will change
On November 20, 2025, the Grand Chamber began consideration of the case regarding the constitutionality of the ban on adoption for persons convicted of crimes against public order and morality. The court is examining the positions of different parties to ensure an objective resolution of this case, to provide a fair balance and to protect the interests of the child.
The Supreme Court has requested the Constitutional Court of Ukraine to check the compliance of certain provisions of the Family Code, which restrict adoption for individuals with a criminal record, with the Constitution of Ukraine. It is argued that such a ban may contradict the principle of rehabilitation and create 'lifelong consequences' for convicted individuals. This step may lead to a violation of justice and weigh on the choice of the child's interests.
The case is currently being considered in writing, and after examining the case materials, the court moved to the closed part of the plenary meeting to make a decision. The presence of representatives of various institutions at the meeting indicates the importance of this issue for Ukrainian society.
