Ukraine's Supreme Court Halts Land Transfer for National Military Cemetery, Raising Fears for Heroes' Graves
Land Transfer Ruled Unlawful
According to Главком: Ukraine's Supreme Court has ruled that the transfer and rezoning of a plot of land in the Marshalivskyi forest near Kyiv for the National Military Memorial Cemetery (NMMC) was illegal. This decision has caused significant concern among the cemetery's representatives and its patronage service, who are now calling for the site's protection. The ruling presents a complex legal challenge for the state, which must now find a way to preserve the sanctity of the burial ground.
The NMMC is the final resting place for unknown soldiers and heroes who died in the battle for Mariupol. Olena Tolkachova, a representative for the interests of these fallen soldiers, expressed deep worry about the potential consequences of the court's decision. She noted that
“the plot near Marshalivka in the Kyiv region is not the best option, but at least this cemetery is operational and open.”
Demand for a Legal Resolution
Tolkachova stressed that the state must now find a legal path forward in the wake of the court's ruling, stating emphatically that
“we will absolutely not allow the dignity of our fallen heroes to be tarnished or their graves to be desecrated.”
The Third Corps, a military formation, condemned the court's decision as an act of 'raider seizure' beyond the bounds of humanity and common sense, urging the public to stand in defense of the National Military Memorial Cemetery.
The Supreme Court's verdict opens new legal questions regarding the cemetery's status and protection. Against the backdrop of the ongoing war, where honoring the memory of the fallen is of paramount national importance, this issue requires urgent resolution. The public and organizations dedicated to memorializing the war dead emphasize the critical need to preserve the dignity of the fallen and their resting places, a principle that must guide the state's next steps in this sensitive matter.
