Alimony for Parents: In Which Cases Children Are Obliged to Support Incapacitated Relatives
According to hvylya.net: Ukrainian children are required to take care of their incapacitated parents - this is mandated by the Constitution. If they do not care for them, the court may impose a financial obligation on them. Such a decision is made when support from the children is absent and may include compulsory collection of funds.

However, the right to receive alimony does not arise automatically. The Supreme Court explained that assistance can only be received by those who cannot provide for themselves. Also, if parents have been deprived of parental rights and this has not been restored, children are exempt from the obligation to take care of them.
In exceptional cases, the court may impose guardianship and financial expenses on the child, for example, for medical services or care for the sick or disabled. The amount of payments may be one-time or regular, depending on the conditions and capabilities of the parties.

The Ministry of Justice emphasizes the importance of balancing legislation in caring for incapacitated parents. The rights of parents must align with the financial capabilities of children who are obliged to care for them.
