According to ХВИЛЯ: Rumors are circulating in Ukraine that the state may confiscate garden plots used for growing personal vegetables. Journalist Kateryna Kotenkova, writing for the publication Znaj.ua, clarifies that this does not apply to privatized land where owners have proper documentation. However, risks of confiscation do exist for plots that have not been privatized.

Land can only be seized through a court decision or via an official procedure for public needs. As Kotenkova noted, the risk of confiscation increases in several specific situations. These include:

  • when the plot appears abandoned;
  • when third parties lay claim to the land;
  • when the user lacks any documents proving their right to use the plot.

In such cases, the legal standing of one's ownership can become problematic.

Land Privatization and Confiscation Risks

Land privatization can be restricted during martial law, which also affects the situation regarding garden plots. 'This is not about privatized land, where you are the owner and have documents,' Kotenkova stated. In practice, cases of land seizure are 'isolated incidents,' but caution is still advised. She also emphasized that

"one piece of paper is worth more than a thousand words"

, which can be a decisive factor in proving one's right to the land.

For those concerned about potential confiscation, Kotenkova recommends several actions:

  • submit a written inquiry to the local council;
  • document the fact of land use;
  • do not give up if difficulties arise and seek a lawyer for professional consultation.
