Rush, who held top-secret security clearance, is charged with criminal misappropriation of public funds. According to court documents, he requested and received large amounts of foreign currency and tens of millions of dollars in gold bars to cover work-related expenses, an FBI agent stated. The requests spanned from November to March. Some of the recovered funds were found in a storage facility near Rush's office.

On May 18, federal agents searched Rush's home, seizing over 300 gold bars valued at more than $40 million, roughly $2 million in cash, and about 35 luxury watches, many of them Rolex brand. The following day, May 19, Rush was taken into custody. Court documents describe him as a former senior official of a U.S. government agency. FBI representatives declined to comment on the case.
According to the FBI affidavit, Rush knowingly appropriated, stole, or converted to his own use property belonging to the United States. His specific CIA role and the date of his departure remain undisclosed. The case documents have been filed in the U.S. District Court for the Eastern District of Virginia.
