Why Ukrainian Pensioners Missed Court-Ordered Payments and When a Fix is Expected

Pensioners with papers, waiting for court payments
Багато українських пенсіонерів стикаються з затримками у виплатах, незважаючи на рішення суду. Коли можна очікувати на вирішення цієї проблеми?

Pensioners Denied Legally Mandated Supplements

According to ХВИЛЯ: A failure to pay court-awarded pension supplements to some Ukrainian retirees in January has caused significant concern among citizens and legal experts. According to Dmytro Korsun, a lawyer with the Merezh Prava (Network of Law) law firm, the primary cause is a specific government regulation: Cabinet of Ministers of Ukraine Resolution No. 821. A series of court hearings scheduled for February in Kyiv aim to address this issue.

The lawyer noted that while the budget for Ukraine's Pension Fund is set to increase from UAH 1.02 trillion in 2026 to UAH 1.263 trillion, with over UAH 1 trillion allocated for pension payments, the legally required supplements are still not being paid. Korsun emphasized that this situation stems from decisions made by the Pension Fund and the Cabinet of Ministers, stating that

"this is not a minor technicality or a temporary difficulty"

- Dmytro Korsun.

Systemic Flaws in the Payment Mechanism

He further pointed out that despite existing court rulings and obligations,

"the funds have not been provided for"

- Dmytro Korsun. He explained that pension payments are being made in amounts proportional to the budget allocations designated for these purposes.

"A court decision cannot be partially executed, only when money is available or within budget limits"

- Korsun stressed.

The expert underscored that a court ruling is not a suggestion but a binding obligation for the state. This ongoing non-payment of pension supplements remains unresolved, pending further action by government bodies and the courts. Retirees are hoping for a swift resolution, as delays can severely impact their financial well-being. This situation highlights a critical gap between judicial authority and budgetary execution in Ukraine's social security system.

In the context of the Pension Fund's growing budget, it is crucial to note that increased funding does not automatically ensure compliance with court orders. This indicates systemic flaws in the payment mechanism that require urgent attention to protect pensioners' rights. The upcoming court hearings could be a vital step toward resolving this problem and improving the financial stability of Ukraine's elderly population.
