Chechelivskyi District Court's Ruling

According to Главком: The Chechelivskyi District Court in Dnipro has altered the pre-trial restrictions for Metropolitan Arseniy (Ihor Yakovenko), releasing him from custody. The court has replaced his detention with 24-hour house arrest, which is set to last until April 25, 2026. The Sviato-Uspenska Sviatohirska Lavra monastery announced this decision on its social media channels.

Metropolitan Arseniy's defense lawyers had petitioned the court to change the measure to either personal surety or house arrest, citing precedents from the European Court of Human Rights. Judge Tetiana Vasylivna Bezruk announced the court's decision, and the next hearing in the Chechelivskyi court is scheduled for March 5 at 11:30 a.m.

The Arrest of Metropolitan Arseniy and Bishop Kyrylo

Metropolitan Arseniy was detained in April 2024 and notified of suspicion for disclosing the positions of Ukrainian troops, an act alleged to have occurred in September 2023. At that time, he reportedly disclosed the names of settlements and the locations of checkpoints and defense force units within the Sviatohirsk community area. He is also accused of attempting to discredit the Ukrainian government and military.

Separately in this case, Bishop Kyrylo (Mykhailiuk) of the Orthodox Church of Ukraine was detained in Ivano-Frankivsk on suspicion of issuing fake certificates to help individuals evade mobilization. The court partially granted the Security Service of Ukraine's request for custody but allowed Bishop Kyrylo to be released on bail of 233,000 hryvnias. He was the head of the Uzhhorod-Khust Diocese of the OCU and is alleged to have established a scheme issuing fraudulent documents of ordination to deacon for men eligible for military service.

This case is significant within the broader context of challenges facing the Ukrainian church hierarchy during wartime, a period of heightened scrutiny for religious figures. The shift in pre-trial restrictions for Metropolitan Arseniy may indicate a degree of legal or political flexibility in his proceedings.
