The top three categories of conscripts who have trouble obtaining a deferral are:
- caregivers for parents,
- large families (complex cases),
- children of parents with disabilities.
To arrange a deferral in such cases, additional documents are required, although the key document is the conclusion of the medical consultation commission. The age of the person being cared for does not matter, which can complicate the situation for some of these individuals.
Roman Simutin also noted that regional recruitment centers (TCC) often refuse to grant deferrals without a written explanation of the reasons. A refusal to grant a deferral must be justified and documented.
'The main problem is not the absence of the right, but formal barriers,' the lawyer emphasized.
He also noted that
'do not agree to verbal refusals: a verbal denial has no legal force and cannot be appealed in court.'
Thus, the problem of obtaining a deferral from mobilization for the three mentioned categories remains relevant, and many citizens may encounter formal obstacles in this process. The importance of this issue underscores the necessity to improve the procedures for obtaining deferrals to ensure legal guarantees for those entitled to them and reduce administrative barriers that prevent people from exercising their legal rights.
