Alimonies will be collected from pensions and property: new rules for collection
According to ХВИЛЯ: The Ministry of Justice of Ukraine has reported that alimonies can be collected not only from salaries but also from pensions or the debtor's property. This innovation is aimed at ensuring more effective fulfillment of obligations regarding alimony payments, which, in turn, is expected to positively impact the financial situation of children in need of material support.
New rules for collecting alimonies
According to the new rules, alimonies can be collected not only from official income, such as salary, pension or scholarship but also from other sources of income. In cases where the debtor has no income, the enforcement of the court's decision may be directed at their property. This allows for adequate support for children whose one parent evades alimony payments.
In determining the amount of alimonies, the court considers the child's health condition as well as the parents' financial situation. If the alimony arrears exceed three months, the debtor is entered into the Unified Register of Debtors. This creates additional pressure on non-payers and accelerates the process of collecting debts.
The enforcement service has the right to appeal to investigative authorities with a statement about criminal offenses for evasion of alimony payments. In case of such violations, the debtor is sent a written explanation about the possibility of criminal prosecution.
