A key point is that social leave for childcare is not counted within this cap. This official clarification was published on March 2, 2026, providing important guidance for workforce planning.

Understanding the Statutory Limits on Leave

Article 10 of Ukraine's 'On Leave' law sets the maximum total duration for basic and additional annual leave at 59 calendar days, with an extended limit of 69 days for underground mining workers. Crucially, the law explicitly states that social leave for children is granted 'over and above the annual leaves' outlined in other articles. This means such social leave is excluded from the calculation of the 59-day maximum.

For instance, an educational worker entitled to 56 days of annual leave could add 10 days of social childcare leave, resulting in a total of 66 calendar days of paid time off. This demonstrates how workers can legally combine their leave entitlements to extend their time away from work.
